Please take notice that the Court, First Division, issued a Resolution datedApril 16, 2018which reads as follows: SDHTEC
"G.R. No. 236529 — NYK-FIL Ship Management, Inc., International Cruise Services, Ltd., and/or Josephine J. Francisco, petitioners vs. Dexter I. Balmeo, respondent.
This Court has carefully reviewed the allegations, issues, and arguments raised in the instant Petition for Review on Certiorari filed under Rule 45 of the Rules of Court and accordingly resolves to DENY the same for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in the assailed April 20, 2017 Decision and January 4, 2018 Resolution in CA-G.R. SP No. 144329 as to warrant the exercise of this Court's discretionary appellate jurisdiction.
It has indeed been held that "[t]here being no appeal seasonably filed x x x, [the Panel of Voluntary Arbitrators'] decision became final and executory after 10 calendar days from x x x receipt of the resolution denying [the] motion for x x x reconsideration [thereof]," 1 as was in this case. And it has been similarly ruled that, "inasmuch as the [Panel of Voluntary Arbitrators'] decision had lapsed into finality, the same may no longer be modified in any respect." 2
ACCORDINGLY, the Court resolves to AFFIRM the April 20, 2017 Decision and January 4, 2018 Resolution of the Court of Appeals in CA-G.R. SP No. 144329.
