Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated26 June 2019which reads as follows:
"G.R. No. 246057 (Ni-Too Aluminium Glass Marketing, Inc. and Conrado Tan v. Elmar P. Manalo and Roger G. Taguibao)
After a judicious study of the case, the Court resolves to DENY the instant petition 2 and AFFIRM the November 22, 2018 Decision 3 and the March 19, 2019 Resolution 4 of the Court of Appeals (CA) in CA-G.R. SP No. 156184 for failure of petitioners Ni-Too Aluminium Glass Marketing, Inc. and Conrado Tan (petitioners) to sufficiently show that the CA committed any reversible error in affirming the January 31, 2018 Decision 5 and the April 30, 2018 Resolution 6 of the National Labor Relations Commission. HTcADC
As correctly ruled by the CA, the parties to a collective bargaining agreement are duty bound to keep the status quo and continue in full force and effect the terms and conditions of the existing agreement until a new one is executed. 7 The CA and the labor tribunals uniformly found that respondents Elmar P. Manalo and Roger G. Taguibao (respondents) had established their entitlement to the voluntary resignation financial assistance benefit. 8 Moreover, petitioners failed to refute the evidence presented by respondents that they were not employed by competitor companies 9 and that there was acceptance of their resignation letters. 10 It is well-settled that the factual findings of quasi-judicial and administrative bodies, if supported by substantial evidence, are accorded great respect and even finality by the courts and this Court will no longer exercise its discretionary power of review in such case. 11
