Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJanuary 7, 2019which reads as follows:
"G.R. No. 241929 (Ana Lou B. Navaja v. People of the Philippines, et al.). — The motion for extension of time to file a petition for review on certiorari filed by petitioner Ana Lou Navaja is GRANTED.
After review of the records, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in dismissing the petition. The CA correctly rejected petitioner's argument that the Municipal Trial Courts in Cities (MTCC) of Iloilo City has no jurisdiction over the case. In Navajo v. De Castro, 1 the Court ruled that the jurisdiction of the court is determined by the allegations in the complaint or information and not as a result of proof. 2 Contrary to petitioner's arguments, the allegations in the Information and the complaint-affidavit make out a prima facie case that such crime was committed in Iloilo City. As to the petitioner's arguments on the credibility of the prosecution witnesses, it is settled that the trial court's factual findings, especially its assessment of the credibility of witnesses, are accorded great weight and respect, and binding upon this Court, particularly when affirmed by the CA.
WHEREFORE, the petition is DENIED. The February 28, 2017 Decision and October 2, 2017 Resolution of the Court of Appeals in CA-G.R. CEB CR No. 02648 are hereby AFFIRMED.
The petitioner's full payment of docket and other lawful fees is NOTED.
