NOTICE
Sirs/Mesdames :
Quoted hereunder, for your information, is a resolution of this Court dated03 September 2008:
G.R. No. 183669 (National Development Company vs. Philippine Phosphate Fertilizer Corporation). — The Court resolves to:
1. GRANT petitioner's motion for extension of thirty (30) days from the expiration of the reglementary period within which to file a petition for review on certiorari, WITH WARNING THAT THE SAME SHALL BE THE LAST AND NO FURTHER EXTENSION will be given; and
2. REQUIRE petitioner to FULLY COMPLY with the Rules by submitting a valid affidavit of service with a competent evidence of the affiant's identity in its jurat pursuant to Sections 6 and 12, Rule II of the 2004 Rules on Notarial Practice, as amended by Court En Banc Resolution dated 19 February 2008 in A.M. No. 02-8-13-SC, within ten (10) days from notice.
Considering the allegations, issues and arguments adduced in the petition for review on certiorari assailing the Decision dated 16 January 2008 and Resolution dated 3 July 2008 of the Court of Appeals, Manila, in CA-G.R. CV No. 88397, the Court further resolves to DENY the petition for failure to sufficiently show any reversible error in the assailed judgment to warrant the exercise by the Court of its discretionary appellate jurisdiction in this case.
