Please take notice that the Court, First Division, issued a Resolution datedJune 4, 2018which reads as follows:
"G.R. No. 237909 (Manuel Moratalla, substituted by Marc Carlo D. Moratalla, and all other persons claiming rights and authority from him v. Vicente C. Tolentino, Jr.). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari with prayer for issuance of temporary restraining order is GRANTED, counted from the expiration of the reglementary period. The Court resolves to DENY the petition for failure to show that the Court of Appeals committed reversible error in finding that possession of the disputed property rightfully belongs to respondent.
The unanimity of the factual findings and legal conclusions of the Metropolitan Trial Court, the Regional Trial Court and the Court of Appeals cannot be ignored, but calls for our acceptance of their judgments on the facts as well as on their legal conclusions upon such facts. Their findings of fact are supported by the evidence on record, while their legal conclusions are in accord with pertinent laws and jurisprudence. There exists no ground for the Court to re-evaluate these factual findings and legal conclusions.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law of the Court of Appeals, and accordingly AFFIRMS its January 29, 2016 Decision and March 6, 2018 Resolution in CA-G.R. SP No. 140136.
