NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated March 13, 2019, which reads as follows:
"A.C. No. 11027 (Mark L. Montinola v. Atty. Daisy D. Montinola). — For resolution is an Administrative Complaint filed on December 28, 2015 by complainant Mark L. Montinola against Atty. Daisy D. Montinola, for allegedly committing the crime of carnapping under Republic Act (R.A.) No. 6539, otherwise known as the "Anti-Carnapping Act of 1972" and violating Rule 1.01, Canon 1 and Rule 7.03, Canon 7 of the Code of Professional Responsibility, docketed as CBD Case No. 16-5203, now A.C. No. 11027.
In his Report and Recommendation dated May 18, 2017, Commissioner Atty. Eduardo B. Robles of the Commission on Bar Discipline, Integrated Bar of the Philippines (IBP-CBD), recommended the dismissal of the complaint without prejudice to the institution of another case should circumstances warrant. In a Resolution dated October 27, 2017, the Board of Governors of the IBP adopted and approved said Report and Recommendation of the IBP-CBD Commissioner.
Finding the recommendation of the IBP to be fully supported by the evidence on record and applicable laws, the Court RESOLVES to DISMISS the case against Atty. Daisy D. Montinola without prejudice to the institution of another case should circumstances warrant.
