Misael P. Vera, et al. vs. Hon. Serafin R. Cuevas, et al.
This is a civil case titled "Republic of the Philippines vs. Hon. Serafin R. Cuevas, et al." (G.R. Nos. L-30793-94) decided by the Philippine Supreme Court on July 30, 1979. The case involves a petition for certiorari and prohibition with preliminary injunction filed by the Commissioner of Internal Revenue and the Fair Trade Board against a writ of preliminary injunction issued by the Court of First Instance of Manila in favor of several filled milk companies. The lower court's decision perpetually restrained the Commissioner of Internal Revenue and the Fair Trade Board from requiring the filled milk companies to print a warning on their products' labels regarding their suitability for infant consumption and from continuing investigations on the companies' manufacturing and selling of their filled milk products. The Supreme Court affirmed the decision of the lower court, rendering the present petition moot and academic. The legal issue in this case is whether the Court of First Instance of Manila had the authority to issue a writ of preliminary injunction against the Commissioner of Internal Revenue and the Fair Trade Board, which the Supreme Court ultimately upheld.
