Please take notice that the Court, First Division, issued a Resolution datedJune 4, 2018which reads as follows:
"G.R. No. 232505 (William Martirez v. Microensure Insurance Brokers Philippines, Inc., Martin Fuller and Richard John Leftley). — The motion for extension of time to file a petition for review on certiorari filed by petitioner William Martirez is GRANTED. TIADCc
After review of the records, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in denying the petition. The CA correctly ruled that the petition was filed out of time. While petitioner invokes the liberal interpretation of the rules of procedure, he fails to show any justifiable cause or circumstance that would warrant the liberal application of the rules. Neither did he attempt to comply with any of the other procedural infirmities in his petition before the CA.
WHEREFORE, the petition is DENIED. The October 20, 2016 and May 30, 2017 Resolutions of the Court of Appeals in CA-G.R. SP No. 10329 are hereby AFFIRMED.
The petitioner's manifestation, enclosing payment for docket fees by way of Manager's Check due to the suspension of the processing/sending of Postal Money Orders by the Philippine Postal Service (Philpost), Iloilo City, is NOTED; the Cash Collection and Disbursement Division is hereby DIRECTED to RETURN to the petitioner the excess payment for the legal fees in the amount of P270.00 under O.R. No. 0185366-SC-EP dated July 19, 2017; and the Court of Appeals and the National Labor Relations Commission are DELETED as party respondents in this case pursuant to Sec. 4, Rule 45, 1997 Rules of Civil Procedure, as amended.
