Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated February 20, 2019 which reads as follows:
"G.R. No. 242357 — Makati Development Corporation, petitioner, vs. Modair Manila Co. Ltd., Inc., respondent.
The Motion for Extension of Time filed by petitioner seeking an additional period of thirty (30) days from the expiration of the reglementary period on October 23, 2018 within which to file the Petition for Review on Certiorari is hereby GRANTED.
Considering the allegations, issues, and arguments adduced in the instant Petition for Review on Certiorari, the Court resolves to DENY the same for failure to show that the Court of Appeals in CA-G.R. SP No. 151233 committed any reversible error.
We agree in toto with the Court of Appeals in upholding the assailed Order dated April 13, 2015 of the Regional Trial Court, Branch 147, Makati City and Order dated March 17, 2017 of the Regional Trial Court, Branch 142, Makati City. The matters raised by petitioner have already been exhaustively and judiciously discussed by the appellate court which are in accordance with law, the rules of procedure, and applicable jurisprudence.
ACCORDINGLY, the Court hereby resolves to AFFIRM the assailed June 18, 2018 Decision and September 28, 2018 Resolution of the Court of Appeals in CA-G.R. SP No. 151233.
Pursuant to Section 4, Rule 45 of the Rules of Court, the Hon. Phoeve C. Meer, as acting Presiding Judge of the Regional Trial Court of Makati City, Branch 142, and Hon. Ronald B. Moreno, as Presiding Judge of the Regional Trial Court of Makati City, Branch 147, are deleted as party respondents.
The Ex-Parte Manifestation (Re: Explanation for Service by Registered Mail to the Court of Appeals) stating that the copy of the Petition for Review on Certiorari was served upon the Court of Appeals through registered mail is hereby NOTED.
