Please take notice that the Court, First Division, issued a Resolution datedNovember 11, 2021which reads as follows:
"G.R. No. 246961 (Magsaysay Maritime Corporation, Ariston Navigation Corporation, and Mr. Arnold B. Javier v. Jonathan B. Peruelo)
The Court resolves to DENY the petition for failure to show any reversible error in the assailed dispositions of the Court of Appeals as to warrant the exercise of this Court's discretionary appellate jurisdiction. The Court, nevertheless, modifies the dispositive portion of the assailed rulings to impose six percent (6%) legal interest per annum in accordance with Nacar v. Gallery Frames. 1
WHEREFORE, the Decision dated January 28, 2019 and Resolution dated April 2, 2019 of the Court of Appeals in CA-G.R. SP No. 154803 are AFFIRMED with MODIFICATION.
Petitioners Magsaysay Maritime Corporation, Ariston Navigation Corporation, and Mr. Arnold B. Javier are ordered to pay in solidum disability benefits of US$60,000.00 plus ten percent (10%) attorney's fees to respondent Jonathan B. Peruelo. These monetary awards shall earn six percent (6%) legal interest per annum from finality of this Resolution until fully paid.
