Please take notice that the Court, First Division, issued a Resolution datedJuly 9, 2018which reads as follows: EHaASD
"UDK-16179 — Natalio Macato y Aradanas vs. People of the Philippines
It appears that petitioner received a copy of the assailed Decision of the Court of Appeals (CA) on October 4, 2017. On October 19, 2017, he filed his Motion for Reconsideration and received the February 7, 2018 Resolution denying the same on March 7, 2018. Under the Rules of Court, petitioner had fifteen (15) days from receipt of said February 7, 2018 Resolution or until March 22, 2018 within which to appeal to this Court via a Petition for Review on Certiorari under Rule 45. On March 22, 2018, petitioner filed his first Motion for Extension of Time to File Petition for Review on Certiorari praying for a 15-day extension to file his Petition for Review on Certiorari. On April 6, 2018, petitioner filed his second Motion for Extension of Time to File Petition for Review on Certiorari. However, these motions were not accompanied by payment of docket and other legal fees. Consequently, petitioner's appeal is not deemed perfected. Rule 45, Sections 3 and 5 in relation to Rule 56, Section 5 (c) of the Rules of Court provides that failure to pay docket and other lawful fees is a ground for dismissal of the Petition.
ACCORDINGLY, the Court resolves to DENY petitioner's Motions for Extension of Time to File Petition for Review on Certiorari, as well as the Petition for Review on Certiorari he subsequently filed.
