Please take notice that the Court, First Division, issued a Resolution datedAugust 8, 2018which reads as follows: HTcADC
"G.R. Nos. 239725-26 (Atty. Oswaldo A. Macadangdang v. Atty. Randolph C. Parcasio). — The motion for extension of time to file petition for review on certiorari filed by petitioner Atty. Oswaldo A. Macadangdang is GRANTED.
After review, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in deleting the award of attorney's fees to petitioner in the Orders dated August 19, 2016 and September 13, 2016 of the Regional Trial Court (RTC). The Court finds no reason to review, more so disturb the factual finding of the CA that petitioner failed to prove that he is the counsel of record of the plaintiffs in the case before the RTC.
WHEREFORE, premises considered, the Decision dated December 21, 2017 and Resolution dated May 4, 2018 of the Court of Appeals in CA-G.R. CV No. 04571 and SP No. 07820 are AFFIRMED.
The petitioner is hereby required to COMPLY within five (5) days from notice hereof with A.M. No. 07-6-5-SC dated July 10, 2007 re: statement of contact details (e.g., telephone number, fax number, cellular phone number or e-mail address) of parties or their counsels in all papers and pleadings filed with the Supreme Court; and the Cash Collection and Disbursement Division is directed to RETURN to petitioner the excess payment for the legal fees in the amount of P320.00 under O.R. No. 0211258-SC-EP dated June 20, 2018.
