Please take notice that the Court, Second Division, issued a Resolution dated29 July 2019which reads as follows:
"G.R. Nos. 242506-10 — LUIS RAMON P. LORENZO, petitioner, versus HON. SANDIGANBAYAN SIXTH DIVISION and THE PEOPLE OF THE PHILIPPINES, respondents.
This resolves the letter 1 dated June 21, 2019 of the Associate Justices of the Sandiganbayan Sixth Division (June 21 letter) seeking clarification of the June 10, 2019 Resolution 2 of the Court in the instant case, which reads:
x x x After deliberating on the petition for certiorari (with prayer for issuance of temporary restraining order) assailing the Resolutions dated 9 August 2018 and 25 September 2018 of the Sandiganbayan in SB-18-CRM-0288 to 0292 entitled, "People of the Philippines vs. Luis Ramon P. Lorenzo, et al.," which denied herein petitioner's omnibus motion to quash/dismiss and motion for reconsideration of the same, respectively, and considering that petitioner's ground for his omnibus motion to quash/dismiss is that the facts charged in the information do not charge an offense and the inordinate delay in the disposition of the cases against him, the Court resolves to: HTcADC
1. REQUIRE respondents to file COMMENT on the petition, not a motion to dismiss, within ten (10) days from notice; and
2. ISSUE, effective immediately and continuing until further orders from this Court, a TEMPORARY RESTRAINING ORDER enjoining the Sandiganbayan Sixth Division, their representatives, agents or other persons acting on their behalf from proceeding with the arraignment and trial of Crim. Case Nos. SB-18-CRM-0288 to 0292, pending final adjudication of the instant case. 3
For reference, the relevant portion of the June 21 letter sent by the Sandiganbayan Sixth Division is quoted below:
We respectfully seek guidance on whether the Sixth Division may act on other incidents such as, but not limited to, motions for authority to travel abroad and the issuance of an order of preventive suspension under Sec. 13 of Republic Act No. 3019. The accused has already been arraigned and the prosecution has commenced with the presentation of its evidence. 4
To clarify the extent and breadth of the coverage of the Temporary Restraining Order issued on June 10, 2019, the Sandiganbayan Sixth Division is directed to submit to the Court, for the latter's disposition, any incident or matter that may be raised concerning the instant case.
WHEREFORE, in view of the Temporary Restraining Order issued by this Court on June 10, 2019, the Sandiganbayan Sixth Division and its representatives, agents, or other persons acting on its behalf, are hereby DIRECTED to submit to this Court, for the latter's resolution, all incidents and matters that may arise from the proceedings in Crim. Case Nos. SB-18-CRM-0288 to 0292, pending final adjudication of the instant case. CAIHTE
