Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 01 August 2018which reads as follows:
"G.R. No. 238956 (Joel O. Lobo v. Sapphire Security Agency and/or Lolita M. Garingan). — After a judicious review of the case, the Court resolves to DENY the instant petition and AFFIRM the Decision dated March 15, 2018 of the Court of Appeals (CA) in CA-G.R. SP No. 07428-MIN for failure of petitioner Joel O. Lobo to show that the CA committed any reversible error in finding that the National Labor Relations Commission (NLRC) did not commit grave abuse of discretion in affirming the Decision of the Executive Labor Arbiter, which dismissed petitioner's complaint for illegal dismissal for lack of merit and/or prescription of action.
The factual findings of the Labor Arbiter and the NLRC, when adopted and confirmed by the CA, as in this case, are binding and conclusive upon this Court, save for certain exceptions which are not present in this case. cSEDTC
