Please take notice that the Court, First Division, issued a Resolution datedApril 23, 2018which reads as follows: TAIaHE
"G.R. No. 236306 (Arnolfo Cortes Linao v. City Service Corporation and Valentin Prieto). — The motion for extension of time to file a petition for review on certiorari filed by petitioner Arnolfo Cortes Linao is GRANTED.
However, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in denying the petition. The CA correctly ruled that the National Labor Relations Commission (NLRC) did not commit grave abuse of discretion when it affirmed the Labor Arbiter (LA) Decision ruling that petitioner was dismissed for just cause. The CA found that petitioner committed serious misconduct in the form of disorderly and violent behavior prohibited by respondent City Service Corporation's Rules and Regulations, specifically: threatening and fighting with a co-worker and possession of a deadly weapon within company premises. The factual findings of the LA and the NLRC when supported by substantial evidence and especially when affirmed by the CA, as in this case, are accorded respect if not finality and are considered binding on this Court.
WHEREFORE, the petition is DENIED. The June 27, 2017 Decision and December 1, 2017 Resolution of the Court of Appeals in CA-G.R. SP No. 149926 are hereby AFFIRMED.
