DAVID A. LIM, petitioner,vs. MARY GRACE O. ROÑA, MEGALAND 168, INC., AND SECURITY BANKING CORPORATION, respondents.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated2 September 2020which reads as follows:
"G.R. No. 252950 (David A. Lim v. Mary Grace O. Roña, Megaland 168, Inc., and Security Banking Corporation). — After a careful review of the case, the Court finds the petition for review on certiorari to be lacking in merit. The Court finds no reversible error on the part of the Court of Appeals when it dismissed petitioner David A. Lim's petition for certiorari for failure to file a Motion for Reconsideration of the Regional Trial Court Order dated 29 April 2019, and for being procedurally infirmed.
WHEREFORE, the Court resolves to DENY the instant petition. The Resolutions dated 20 June 2019 and 26 June 2020 issued by the Court of Appeals in CA-G.R. SP No. 161064 are AFFIRMED.
With the denial of the instant petition, the petitioner's prayer for the issuance of a temporary restraining order and/or writ of preliminary injunction is necessarily DENIED.
SO ORDERED." (Baltazar-Padilla, J., on leave.)
