NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedAugust 15, 2022, which reads as follows:
"G.R. No. 259904 (Jesusito D. Legaspi v. Arturo Awitan Mangalino). — The Court resolves to DENY the Petition for Review on Certiorari for failure to show any reversible error in the assailed judgment as to warrant the exercise of this Court's discretionary appellate jurisdiction pursuant to Section 6, Rule 45 of the Rules of Court.
Petitioner Jesusito D. Legaspi, in his capacity as the sole proprietor of J.D. Legaspi Corporation (JDLC), was enjoined to pay respondent Arturo A. Mangalino the aggregate amount of P125,848.98 representing respondent's separation pay, backwages, 13th month pay, the monetary equivalent of his service incentive leave, and attorney's fees.
However, following Nacar v. Gallery Frames, 1 the total monetary award should earn legal interest at the rate of six percent (6%) per annum from the finality of this Resolution until fully paid by the petitioner.
WHEREFORE, the Petition for Review on Certiorari is DENIED. The Decision dated July 22, 2021 and the Resolution dated February 22, 2022 of the Court of Appeals in CA-G.R. SP No. 165726 are hereby AFFIRMED with MODIFICATION in that the total monetary award shall earn legal interest at the rate of six percent (6%) per annum from the finality of this Resolution until full payment.
The petitioner is required to SUBMIT, within five days from notice hereof, a soft copy in compact disc, USB or e-mail containing the PDF file of the signed petition for review on certiorari and annexes pursuant to A.M. Nos. 10-3-7-SC and 11-9-4-SC.
