The Court RESOLVES to ADOPT and APPROVE the findings of fact, conclusions of law, and recommendation of the Office of the Court Administrator in the attached Memorandum 1 dated October 5, 2017. Accordingly, the instant administrative complaint against respondent Judge Divina Luz P. Aquino-Simbulan, Presiding Judge, Branch 41, Regional Trial Court, City of San Fernando, Pampanga, as well as her counter-charge against Atty. Rony A. Garay, are DISMISSED for lack of substantial evidence. However, the Court finds complainant Delfin S. Lee GUILTY of contempt of court and is hereby FINED in the amount of P15,000.00 payable within fifteen (15) days from notice.
