NOTICE
Sirs/Mesdames:
Please take notice that the Court, First Division, issued a Resolution dated November 23, 2021which reads as follows:
"G.R. No. 256650 — LEADING INTERNATIONAL RECRUITMENT CORPORATION (Formerly LWV CORPORATION), petitioner, versusJO-ANN V. ARIENZA, respondent.
This is Petition for Review on Certiorari1 (Petition) under Rule 45 of the Rules of Court, assailing the Decision 2 dated August 28, 2020 and Resolution 3 dated May 20, 2021 of the Court of Appeals 4 (CA) in CA-G.R. SP No. 161782 where the CA denied the petition for certiorari and affirmed the ruling of the National Labor Relations Commission (NLRC) that respondent is entitled to food allowance.
After a judicious review of the Petition and its annexes, the Court finds that the Petition lacks merit as it failed to show that the CA committed any reversible error in denying the petition for certiorari. HTcADC
The CA was correct when it affirmed the ruling of the NLRC that respondent is entitled to food allowance. Since the CA and the NLRC's findings are supported by substantial evidence, these are binding on the Court.
Following prevailing jurisprudence, 5 however, legal interest at the rate of six percent (6%) per annum should be imposed on the total monetary award of the NLRC, reckoned from the finality of this Resolution until full payment.
WHEREFORE, premises considered, the Court resolves to DENY the Petition and AFFIRM the Decision dated August 28, 2020 and Resolution dated May 20, 2021 of the Court of Appeals in CA-G.R. SP No. 161782.
Legal interest at the rate of six percent (6%) per annum is imposed on the total monetary award of the National Labor Relations Commission, reckoned from the finality of this Resolution until full payment.
The National Labor Relations Commission is hereby DROPPED as party respondent in this case pursuant to Section 4, Rule 45 of the Rules of Court.
