NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated January 16, 2019 which reads as follows:
"G.R. No. 241980 (Land Bank of the Philippines v. Superior Agro-Industrial, Inc.). — The motion for extension of time filed by petitioner Land Bank of the Philippines is GRANTED.
After a review, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in denying the petition. The CA correctly ruled that since the petitioner actually received the Special Agrarian Court's Order on March 13, 2018, petitioner's motion for extension of time before the CA, which was filed on May 4, 2018, was filed out of time as there was no more period to extend.
There is a presumption that official duties have been regularly performed. In this case, the Affidavit/Certification of the alleged Letter-Carrier of the Philippine Postal Corporation-Lucena, Arjay. D. Ranillo (Ranillo), cannot give rise to such a presumption for it attests to an irregularity in the performance of official duties. Furthermore, the affidavits of Ranillo and Lorielyn M. Aliwalas cannot be given any probative value since they were both notarized by Atty. Aristeo Mariscal of the Land Bank of the Philippines and, as such, are self-serving assertions. 1
WHEREFORE, the June 27, 2018 and September 4, 2018 Resolutions of the Court of Appeals in CA-G.R. SP No. 155594 are hereby AFFIRMED.
