FIRST DIVISION
[G.R. No. 237891. July 2, 2018.]
LAND BANK OF THE PHILIPPINES, petitioner, vs.SPOUSES SEVERO AND TERESITA BARTOLOME AND DOMINADOR C. TORIO, respondents.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJuly 2, 2018which reads as follows:
"G.R. No. 237891 (Land Bank of the Philippines v. Spouses Severo and Teresita Bartolome and Dominador C. Torio). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its Decision dated October 23, 2017 and its Resolution dated February 26, 2018. The Court of Appeals is correct in holding that a person who, in good faith, first recorded his acquisition of an immovable property with the Register of Property is to whom the ownership of the property shall belong. cCHITA
We also find no sufficient reason to disturb the findings of the Regional Trial Court and the Court of Appeals. Their findings are accorded great weight and respect by, and are even binding on this Court particularly when they concur, as in this case. 1
WHEREFORE, the petition is DENIED. The Court of Appeals' Decision dated October 23, 2017 and Resolution dated February 26, 2018 in CA-G.R. CV No. 107928 are AFFIRMED.
SO ORDERED." Leonardo-De Castro, J., on official leave; Del Castillo, J., designated Acting Chairperson of the First Division per Special Order No. 2562 dated June 20, 2018;Gesmundo, J., designated as Acting Member of the First Division per Special Order No. 2560 dated May 11, 2018.
Very truly yours,
(SGD.) LIBRADA C. BUENAActing Division Clerk of Court
