Please take notice that the Court, First Division, issued a Resolution datedMarch 2, 2022which reads as follows: HTcADC
"G.R. No. 256178 (Land Bank of the Philippines v. Leonila Valino Garcia represented by Attorney-in-Fact Norman Valino Cabrera and Glenn C. Garcia). — The Court resolves to DENY the petition for review on certiorari filed by Land Bank of the Philippines (petitioner) for failure to sufficiently show that the Court of Appeals committed any reversible error in its Decision 1 dated February 28, 2020, and Resolution 2 dated March 11, 2021, in CA-G.R. CV No. 111632 and CA-G.R. SP No. 157001, which affirmed with modification the Decision 3 dated June 6, 2018 of the Regional Trial Court of Cabanatuan City, Branch 23.
However, there is a need to clarify the imposition of interest to conform with jurisprudence 4 and for facility in execution.
WHEREFORE, the Decision dated February 28, 2020 and Resolution dated March 11, 2021 of the Court of Appeals in CA-G.R. CV No. 111632 and CA-G.R. SP No. 157001 are AFFIRMED with MODIFICATION in that interest is imposed as follows:
1. The amount of P1,840,115.30 representing the difference between the final amount of just compensation and the initial deposit made shall earn legal interest at the rate of twelve percent (12%) per annum computed from the date of taking of the property until June 30, 2013. Thereafter, the same amount shall earn legal interest at the rate of six percent (6%) per annum from July 1, 2013 until the finality of this Resolution.
In addition, the total amount of just compensation (P3,799,234.31) shall earn legal interest of six percent (6%) per annum from the finality of this Resolution until full payment thereof.
