NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated April 10, 2013, which reads as follows:
"G.R. No. 184279 (Lanao Del Norte Electric Cooperative (LANECO) v. Sylvia Baclayon). — After a careful review of the records, We hold that the Court of Appeals (CA) did not commit any reversible error in its assailed Decision. Consequently, the Court resolves to DENY the petition for lack of merit.
It is well settled that the findings of fact of the trial court, especially when affirmed by the CA, are accorded the highest degree of respect and, generally, will not be disturbed on appeal. Such findings are binding and conclusive upon this Court. 1 The trial court and the CA were unanimous in their findings that petitioner's failure to make the necessary repairs and replacement of the defective transformer were the proximate cause of the fire that totally burned the respondent's store.
