NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJune 19, 2019which reads as follows:
"G.R. No. 244739 (Thomas Kiwang y Buyagaw v. People of the Philippines). — After review, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in upholding the finding of guilt of petitioner Thomas Kiwang y Buyagaw for the crime of homicide. This Court shall no longer disturb the uniform factual findings of the Regional Trial Court and the CA, which are entitled to great weight and respect. However, the award of civil indemnity should be reduced to P50,000.00, in accordance with People v. Jugueta. 1 HTcADC
WHEREFORE, the petition is DENIED. The Decision dated May 11, 2018 and Resolution dated February 11, 2019 of the Court of Appeals in CA-G.R. CR No. 39943 finding petitioner GUILTY beyond reasonable doubt of the crime of homicide and sentencing him to a penalty of imprisonment of 8 years and 6 months of prision mayor as minimum to 15 years of reclusion temporal as maximum, as well as ordering him to pay the heirs of Victor Raul Lingbanan P139,134.00 as actual damages and P50,000.00 as moral damages, is AFFIRMED with the MODIFICATION that the civil indemnity to be paid by petitioner is reduced to P50,000.00 and all damages awarded shall earn interest at the rate of 6% per annum from the finality of this Decision until fully paid.
