Kilusan sa Pagbabago ng Industriya ng Transportasyon, Inc. v. City of Manila
This is a civil case (G.R. No. 261892 & G.R. No. 262192) decided by the Philippine Supreme Court on August 30, 2022. The Court issued a Temporary Restraining Order (TRO) against the implementation of the No Physical Contact Apprehension Policy and related ordinances by the cities of Manila, Quezon City, Valenzuela, Parañaque, Muntinlupa, and the Land Transportation Office. The TRO prohibits the apprehension, imposition and/or collection of fines, as well as the disclosure of motorist information to local government units enforcing such policies. The respondents are required to comment on the petition within ten days, and the case is set for oral arguments on January 24, 2023. The legal issue in this case concerns the constitutionality and legality of the No Physical Contact Apprehension Policy and related ordinances.

Please take notice that the Court en banc issued a Resolution datedAUGUST 30, 2022, which reads as follows:
"G.R. No. 261892 (Kilusan sa Pagbabago ng Industriya ng Transportasyon, Inc., ["KAPIT"], Pangkalahatang Sanggunian Manila & Suburds Drivers Association Nationwide, Inc., ["PASANG MASDA"], Alliance of Transport Operators and Drivers Association of the Philippines, ["ALTODAP"], and Alliance of Concerned Transport Organization ["ACTO"], v. City of Manila, Quezon City, Valenzuela City, Paranaque City, Muntinlupa City, and Land Transportation Office) and G.R. No. 262192 (Atty. Juman B. Paa v. Sangguniang Panglungsod ng Manila and Hon. Dr. Maria Sheilah Lacuna-Pangan). — The Court RESOLVES, in the interest of expediency, and without necessarily giving due course to the Petitions, to:
(a) NOTE the Manifestation dated 23 August 2022 filed by the counsel for respondent City of Valenzuela and the Manifestation and Motion dated 26 August 2022 filed by counsel for respondent Parañaque City in G.R. No. 261892 and DIRECT the petitioners in G.R. No. 261892 to SERVE anew copies of the Petition upon respondents City of Valenzuela and Parañaque City;
(b) REQUIRE the respondents Sangguniang Panglungsod ng Manila and Hon. Dr. Maria Sheilah Lacuna-Pangan to COMMENT on the Petition in G.R. No. 262192 within a NON-EXTENDIBLE period of ten (10) days from notice;
(c) ISSUE a TEMPORARY RESTRAINING ORDER, effective immediately and continuing until further orders from this Court, enjoining respondents City of Manila, Quezon City, Valenzuela City, Parañaque City, Muntinlupa City, and the Land Transportation Office (LTO) and all parties acting for and on their behalf from implementing MMDA Resolution No. 16-01, s. 2016 and all ordinances subject of these Petitions. Any apprehension, imposition and/or collection of a fine through the No Physical Contact Apprehension Policy and ordinances related thereto shall be prohibited until further orders from this Court;
(d) ISSUE a TEMPORARY RESTRAINING ORDER, effective immediately and continuing until further orders from this Court, enjoining the Land Transportation Office and all parties acting on its behalf from giving out motorist information to all local government units, cities, and municipalities enforcing No Physical Contact Apprehension Policy and Ordinances; and
(e) SET the Petitions for ORAL ARGUMENTS on 24 January 2023, at 2:00 in the afternoon, at the New Session Hall, New Supreme Court Building, Padre Faura Street, Ermita, Manila." (adv18, 23 and 25) CAIHTE
