Please take notice that the Court, First Division, issued a Resolution datedJune 20, 2018which reads as follows:
"G.R. No. 238366 (Mariam K. Kairuz, Ramzy Mansour Kairuz, Layla Elaine Tanya Kairuz, and Lily Rita Kairuz v. Bali Irisan Resources, Inc., Elizabeth Kairuz D'Alessandri, and Vivien K. Kairuz). — After review of the records, the Court resolves to DENY the petition for failure of petitioners to show any reversible error in the assailed ruling. The Court of Appeals (CA) correctly affirmed the Regional Trial Court's (RTC) finding that petitioners failed to prove by a preponderance of evidence that the Deed of Assignment was merely an unaccepted offer, and even if it ripened into a contract, that respondent Bali Irisan Resources, Inc. did not pay the consideration for the assignment to it of the shares of stock. Factual findings of the RTC, when sufficiently supported by evidence on record, and especially when affirmed by the CA, as in this case, are accorded respect if not finality and are considered binding on this Court. aScITE
WHEREFORE, premises considered, the petition is DENIED. The November 27, 2017 Decision and March 13, 2018 Resolution of the Court of Appeals in CA-G.R. CV No. 106756 are hereby AFFIRMED.
