IN RE: PETITION TO TAKE THE LAWYER'S OATH AND SIGN THE ROLL OF ATTORNEYS, NAPOLEON REGAN MALIMAS, petitioner.
NOTICE
Sirs/Mesdames :
Please take notice that the Court en banc issued a Resolution dated JANUARY 8, 2013, which reads as follows:
"B.M. No. 2504(In Re: Petition to Take the Lawyer's Oath and Sign the Roll of Attorneys, Napoleon Regan Malimas, Petitioner). — This resolves the Petition to Take the Lawyer's Oath and Sign the Roll of Attorneys filed on March 9, 2012 by Napoleon Regan Malimas (petitioner).
In the Resolution of March 20, 2012, the Court allowed petitioner to take the Lawyer's Oath during the mass oath-taking ceremony on March 21, 2012 but held in abeyance his Roll signing pending the resolution of the criminal complaint for Serious Physical Injuries filed against him.
In his Manifestation and Motion dated September 25, 2012, petitioner stated that the criminal information in that case was ordered withdrawn in the Order dated September 25, 2012 issued by Judge Josefino A. Subia, Presiding Judge of Branch 66 of the Makati Metropolitan Trial Court. The Order was anchored on the Motion to Withdraw filed by the Makati City Prosecutor in compliance with the DOJ Resolution dated August 6, 2012 directing it to withdraw the criminal information filed against petitioner.
On November 6, 2012, petitioner informed the Court that the motion for reconsideration of the Order dated September 25, 2012 filed by therein complainant was already denied in the Order dated October 29, 2012 issued by Judge Subia. 1 Petitioner states that with the withdrawal of the criminal charge against him, there is no more legal obstacle for him to sign the Roll of Attorneys.
The record shows that petitioner, on March 9, 2012, already submitted certifications from the following people attesting to his good moral character:
1) Sr. Eva Fidela Maamo, SPC, MD, Foundation of Our Lady of Peace Mission, Inc., Parañaque City;
2) Rev. Fr. Jose R. Gonzales, OSA, Parish Priest, Nuestra Señora de Gracia Parish, Makati City; and
3) Barangay Chairman Edgardo M. Lugay of Barangay Guadalupe Viejo, Makati City.
The Court finds the above as sufficient compliance to attest that petitioner possesses the good moral character required of a member of the Philippine Bar.
IN VIEW OF THE FOREGOING, the petition is GRANTED. Petitioner Napoleon Regan Malimas is allowed to SIGN the Roll of Attorneys on a date to be set by the Court, subject to the payment of appropriate fees. Let this resolution be attached to petitioner's personal records in the Office of the Bar Confidant."
