HEIRS OF DELIA P. QUITASOL, NAMELY: WELLINGTON QUITASOL, ARLENE QUITASOL-PADILLA, RUFINO QUITASOL, NELSON QUITASOL AND LYDIO QUITASOL, petitioners,vs. HEIRS OF MATEO OLAVERE, NAMELY: MANUEL OLAVERE AND BERNARDINA OLAVERE, respondents.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated March 13, 2019 which reads as follows:
"G.R. No. 243498 — Heirs of Delia P. Quitasol, namely: Wellington Quitasol, Arlene Quitasol-Padilla, Rufino Quitasol, Nelson Quitasol and Lydio Quitasol, petitioners, vs. Heirs of Mateo Olavere, namely: Manuel Olavere and Bernardina Olavere, respondents.
Acting on petitioners' Motion for Extension seeking an additional period of thirty (30) days from the expiration of the reglementary period on December 5, 2018 within which to file their Petition for Review on Certiorari, the Court resolves to DENY the same for petitioners' failure to pay the Sheriff's Trust Fund per A.M. 17-12-09-SC in the amount of P530.00 and for failure to explain why service of the Motion for Extension upon the Court of Appeals and the adverse party was not done personally, in violation of Rule 13, Section 11 of the Rules of Court.
Thus, the Petition for Review on Certiorari is hereby DENIED for late filing under Rule 45, Section 2 in relation to Rule 56, Section 5 of the Rules of Court.
Even assuming that the Court grants petitioners' Motion for Extension, the Petition must still be denied for failure of the petitioners to attach a copy of the assailed Court of Appeals Resolution in violation of Rule 45, Section 4 (d) and Section 5 in relation to Rule 56, Section 5 (d).
ACCORDINGLY, the Court resolves to DENY the instant Petition for Review on Certiorari.
SO ORDERED."
Very truly yours,
(SGD.) LIBRADA C. BUENADivision Clerk of Court
