G.R. No. 244779 (Notice)

This is a civil case, titled "The Heirs of Datu Zubair Yusof (Jose) Linsag, namely: Abdul Rahman Ruben, et al. vs. Remman Enterprises, Inc., herein rep. by Manuel P. Blanco, Jr., et al." The case was resolved by the First Division of the Supreme Court through a Resolution dated July 10, 2019. The Court denied the petition for being filed out of time, as the petitioners had until April 22, 2019 to file their petition but they only filed it on April 24, 2019. The Court also noted that the petitioners failed to justify their direct resort to this Court when there are available remedies before the Court of Appeals. Additionally, the Court ruled that any further litigation on this matter is barred pursuant to the principle of res judicata, citing Linzag v. Court of Appeals (G.R. No. 122181, June 26, 1998, 291 SCRA 304). The motion to admit the petition for review on certiorari was noted.

NOTICE

Sirs/Mesdames :

Please take notice that the Court, First Division, issued a Resolution datedJuly 10, 2019which reads as follows:

"G.R. No. 244779 (The Heirs of Datu Zubair Yusof (Jose) Linsag, namely: Abdul Rahman Ruben, et al. v. Remman Enterprises, Inc., herein rep. by Manuel P. Blanco, Jr., et al.). — The urgent motion for extension of time to file petition for review on certiorari filed by petitioners is GRANTED.

After review, the Court resolves to DENY the petition for being filed out of time. Petitioners had until April 22, 2019 to file their petition but they only filed it on April 24, 2019. Further, petitioners failed to justify their direct resort to this Court when there are available remedies before the Court of Appeals. In any case, our ruling in Linzag v. Court of Appeals1 bars any further litigation on this matter pursuant to the principle of res judicata. HTcADC

WHEREFORE, premises considered, the petition is DENIED.

The petitioners' motion to admit the petition for review on certiorari, for reason stated therein is NOTED.

The counsel for petitioners is hereby directed to COMPLY within five (5) days from notice hereof with A.M. No. 07-6-5-SC dated July 10, 2007 re: statement of contact details (e.g., telephone number, fax number, cellular phone number or e-mail address) of parties or their counsels in all papers and pleadings filed with the Supreme Court.
