NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution datedJanuary 13, 2021, which reads as follows:
"G.R. No. 226171 (WILSON GUE, petitionerv. PEOPLE OF THEPHILIPPINES and EILEEN CAGALINGAN GUE, respondents). — In the light of this Court's power in Article VIII, Section 5 (5) of the Constitution 1 for the "protection and enforcement of constitutional rights[,]" the specific factual circumstances of this case, and in order to maintain judicial economy and efficiency, the parties are required to MOVE IN THE PREMISES within a non-extendible period of 20 days upon receipt of this order to address the following issues: HTcADC
(a) Whether or not this Court may still take jurisdiction over this case in view of the relationship of the crime charged and the due process clause of the Constitution specifically, the right to privacy and intimacy of the accused; and
(b) Whether or not this Court may still take jurisdiction over this case in view of Article II, Section 14 2 requiring "fundamental equality before the law of women and men" and Article III, Section 1 3 requiring "equal protection of the laws" in the Constitution.
The parties may make further manifestations as may be warranted relating to the legal issues in this case.
A copy of the motion and/or manifestation of the parties should also be served upon the Solicitor General in view of the constitutional issues involved. The Solicitor General is given a non-extendible period of 30 days upon receipt of the last motion and/or manifestation to submit its comments.
All parties and their counsels shall be served immediately and personally. All submissions of all parties and the Solicitor General shall be filed and served personally.

1. CONST., art. VIII, sec. 5 (5) provides:
SECTION 5. The Supreme Court shall have the following powers:

(5) Promulgate rules concerning the protection and enforcement of constitutional rights, pleading, practice, and procedure in all courts, the admission to the practice of law, the Integrated Bar, and legal assistance to the underprivileged. Such rules shall provide a simplified and inexpensive procedure for the speedy disposition of cases, shall be uniform for all courts of the same grade, and shall not diminish, increase, or modify substantive rights. Rules of procedure of special courts and quasi-judicial bodies shall remain effective unless disapproved by the Supreme Court.

SECTION 14. The State recognizes the role of women in nation-building, and shall ensure the fundamental equality before the law of women and men.
3. CONST., art. III, sec. 1 provides:
SECTION 1. No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws.
