This is a civil case where the Supreme Court of the Philippines issued a Writ of Kalikasan against the Environmental Management Bureau of the Department of Environment and Natural Resources, Bureau of Plant Industry and the Fertilizer and Pesticide Authority of the Department of Agriculture, UP Los Baos Foundation, Inc., UP Mindanao Foundation, Inc. and International Service for the Acquisition of Agri-Biotech Applications-Southeast Asia Center. The petitioners, including Greenpeace Southeast Asia and Magsasaka at Siyentipiko sa Pagpapaunlad ng Agrikultura, sought the issuance of the writ regarding the open field testing and commercialization of genetically modified organisms (GMOs) in the Philippines. The Court required the petitioners to comply with several requirements, including the submission of a clearly legible duplicate original or certified true copy of the assailed Memorandum of Undertaking and the service of a copy of the petition on the Office of the Solicitor General. The Court also held in abeyance the prayer for the issuance of the writ of continuing mandamus pending the filing of respondents' verified return.

Please take notice that the Court en banc issued a Resolution dated MAY 2, 2012, which reads as follows:

Maria Paz Luna, Mr. Juanito Modina, Mr. Dagohoy Magaway, Dr. Romeo Quijano, Dr. Wency Kiat, Atty. H. Harry Roque, Jr., Former Sen. (a) ISSUE a WRIT OF KALIKASAN against the respondents; SHCaEA

(b) ORDER the respondents to make a VERIFIED RETURN of the Writ of Kalikasan before this Court within a NON-EXTENDIBLE period of ten (10) days from receipt hereof as provided in Section 8, Rule 7 of The Rules of Procedure for Environmental Cases;

(c) REQUIRE the petitioners to COMPLY, within five (5) days from notice hereof, with the requirement that the petition be accompanied with a clearly legible duplicate original or certified true copy of the assailed Memorandum of Undertaking pursuant to Section 2, Rule 22 of The Rules of Procedure for Environmental Cases in relation to Section 3, Rule 46 and Section 2, Rule 56, 1997 Rules of Civil Procedure, as amended;

(d) REQUIRE the petitioners to SERVE a copy of the petition on the Office of the Solicitor General, also within five (5) days from notice hereof, pursuant to Section 6, Rule 2 of The Rules of Procedure for Environmental Cases; and

(e) HOLD IN ABEYANCE the prayer for the issuance of the writ of continuing mandamus pending the filing of respondents' verified return." Leonardo-de Castro, J., on official business. (adv2)
