Please take notice that the Court, First Division, issued a Resolution datedSeptember 7, 2022, which reads as follows: HTcADC
"JIB FPI No. 21-051-MTJ (Emilia Velasco Gorteza v. Presiding Judge Kristine Aquino-Ferrer, Municipal Trial Court, Lupao, Nueva Ecija). — The Court NOTES the: 1) VERIFIED COMPLAINT FOR CROSS IGNORANCE OF THE LAW/MANDAMUS AND FOR INHIBITION1 dated November 11, 2021 by Emilia Velasco Gorteza (complainant) charging respondent Presiding Judge Kristin Aquino-Ferrer (respondent) with gross ignorance of the law for ordering the parties to submit their respective position papers and for not referring the case to the Department of Agrarian Reform, relative to Civil Case No. 1227-21, a complaint for forcible entry, filed before the Municipal Trial Court, Third Judicial Region, Lupao, Nueva Ecija; and the 2) REPORT2 dated May 25, 2022 of the Judicial Integrity Board (JIB), recommending that the instant complaint against respondent be DISMISSED for being judicial in nature.
Finding the evaluation and recommendation of the JIB for the dismissal of the complaint for being judicial in nature to be fully supported by the evidence on record and by applicable laws and jurisprudence, the Court RESOLVES to ADOPT and APPROVE the same. The complaint against Judge Kristine Aquino-Ferrer is DISMISSED.
