Please take notice that the Court, First Division, issued a Resolution datedApril 4, 2018which reads as follows: TIADCc
"G.R. No. 235969 (Ma. Anie A. Gonzales v. Dr. Gabriel G. Tan, Jr. and Dr. Corazon M. Velasquez). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review of the records, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in affirming the Decision dated February 29, 2016 of the National Labor Relations Commission (NLRC) Third Division in NLRC LAC No. 01-000371-16 (NLRC-NCR Case No. 05-06087-15).
Rule 45 limits us to the review of questions of law raised against the assailed CA Decision. We examine the CA Decision from the prism of whether it correctly determined the presence or absence of grave abuse of discretion in the NLRC Decision before it, not on the basis of whether the NLRC Decision on the merits of the case was correct. Accordingly, it is not our task to re-examine conflicting evidence, re-evaluate the credibility of witnesses, or substitute the findings of fact of the NLRC, an administrative body that has expertise in its specialized field. Therefore, the factual findings of the NLRC, when affirmed by the CA, are generally conclusive on this Court. 1
WHEREFORE, premises considered, the petition is DENIED. The assailed Decision dated May 9, 2017 and Resolution dated December 4, 2017 in CA-G.R. SP No. 145701 are hereby AFFIRMED. AIDSTE
