G.R. No. 199475 (Notice)

This is a civil case decided by the Third Division of the Supreme Court of the Philippines in 2012. The case concerns Gold's Gym Incorporated and several of its officers, who petitioned the Court against the decision of the Court of Appeals finding that they illegally terminated several employees. The Supreme Court denied the petition, holding that the verification of the petition was defective because it was signed by two officers without proof of authority to sign for the other petitioners. Furthermore, the Court found that the employees were indeed illegally terminated.

Please take notice that the Court, Third Division, issued a Resolution dated 14 March 2012, which reads as follows:

G.R. No. 199475(Gold's Gym Incorporated, Victor Siasat, James Campbell, Ma. Elena M. Dayrit, Leila Fernandez and Jesi Castillo v. Cielito Jose Cruz, Ronaldo E. Ibasco, Josue Borja, Rowena Bertillo and Alvin de Guzman).

RESOLUTION

After a review of the records, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed reversible error in finding that respondents Cielito Jose Cruz, Ronaldo E. Ibasco, Josue Borja, Rowena Bertillo and Alvin de Guzman have been illegally terminated from work by the petitioner.

Moreover, the verification was signed by Victor Siasat and Ma. Elena Dayrit without proof of authority to sign for and on behalf of other petitioners.
