NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution datedMarch 5, 2018, which reads as follows: cDHAES
"G.R. No. 235065 (Girly Giron-Chavez v. People of the Philippines and Esperanza A. Domdom). — After considering the allegations, issues, and arguments adduced in the Petition for Review on Certiorari, 1 assailing the Court of Appeals April 21, 2017 Decision 2 and October 19, 2017 Resolution 3 in CA-G.R. CR No. 38438, this Court resolves to DENY the petition for failure to show any reversible error in the assailed judgments as to warrant the exercise of this Court's discretionary appellate jurisdiction, and for raising substantially factual issues.
However, in view of this Court's ruling in Nacar v. Gallery Frames4 as to the proper rate of legal interest, the dispositive portion of the assailed Decision is MODIFIED.
WHEREFORE, the findings of fact and conclusions of law of the Court of Appeals are AFFIRMED with MODIFICATION. Petitioner Girly Giron-Chavez is found GUILTY beyond reasonable doubt of slight physical injuries and is sentenced to suffer the penalty of twenty (20) days of arresto menor. Moreover, she is ordered to pay private respondent Esperanza A. Domdom P10,000.00 as moral damages, P25,000.00 as attorney's fees, and the costs of suit. In line with current jurisprudence, interest at the rate of six percent (6%) per annum shall be imposed on all monetary awards from the date of the finality of the judgment in this case until fully paid. 5
