NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJanuary 7, 2019which reads as follows:
"G.R. No. 241236 (Stephen Gavino and Aristotle Ladip v. People of the Philippines). — The motion for extension of time to file a petition for review on certiorari filed by petitioners Stephen Gavino and Aristotle Ladip is GRANTED.
After review, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in upholding the finding of guilt of petitioners for the crime of murder. We shall no longer disturb the findings of fact of the trial court, as it was duly sustained by the CA. In addition, the petition lacks verification and certification on non-forum shopping.
WHEREFORE, the petition is DENIED. The August 3, 2018 Decision of the CA in CA-G.R. CR HC No. 09371 finding petitioners guilty beyond reasonable doubt of murder and sentencing each of them to suffer reclusion perpetua and to pay jointly and severally the heirs of James Labao the following amounts: P75,000 as civil damages; P75,000 as exemplary damages; P75,000 as moral damages; and P50,000 as temperate damages, subject to an interest of six percent (6%) per annum from finality of this resolution until its full satisfaction, is AFFIRMED.
