Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJune 19, 2019which reads as follows:
"G.R. No. 243998 (Apolonia B. Frianela v. Socorro Banayad Adame, Bonifacio Banayad, Jr., et al.). — The petitioner's first and second motions for extension of time totaling twenty-two (22) days within which to file a petition for review on certiorari are GRANTED, counted from the expiration of the reglementary period.
After a judicious perusal of the case, the Court resolves to DENY the instant petition for review on certiorari and AFFIRM the Decision dated May 19, 2017 and Resolution dated December 17, 2018 of the Court of Appeals (CA) in CA-G.R. SP No. 146519.
The CA correctly upheld the Regional Trial Court's Order dated March 5, 2015. The trial court and the CA found that respondents were not made parties to the Compromise Agreement entered into between petitioner and Servillano Banayad, Jr. The judgment approving the Compromise Agreement becomes unjustified and inequitable to them especially in light of the CA's findings that there can be no disposition of Moises Banayad's properties without his holographic will being probated. WHEREFORE, premises considered, the Decision dated May 19, 2017 and Resolution dated December 17, 2018 of the Court of Appeals in CA-G.R. SP No. 146519 are hereby AFFIRMED.
