CONCEPCION, J.:
Esta es una queja presentada por Franz Rosenswaig contra el abogado Benjamin B. Pineda por malas practicas. Despues de una investigacion por el Procurador General, a quien se habia dado trasladado, de la queja para la accion correspondiente, se presento una queja formal por el mismo Procurador General en 2 de mayo de 1939, en la cual se alegan varios hechos que pueden reducirse en sintesis a que el recurrido, mediante falsas manifestaciones, hizo creer al denunciante, que entonces residia en Hongkong, que habia buenos negocios en Manila en que podria interesarse con la perspectiva de buenas utilidades; que en su capacidad de abogado, hizo varias gestiones para que el denunciante con su familia pudiese venir a Filipinas, y el denunciante creyendo en la buena fe del recurrido, le entrego varias cantidades de dinero. Que el recurrido no invirtio el dinero en negocio alguno, y se ha negado y sigue negando a devolverlo al denunciante. Los hechos y las pruebas que los sustancian, extensamente se exponen en el minucioso informe del Comisionado.
El Comisionado es de opinion, que el recurrido Benjamin B. Pineda, por su conducta se ha hecho indigno de continuar ejerciendo la noble profesion de la abogacia, y recomienda que se le suspenda indefinidamente en el ejercicio de la profesion hasta que le reintegre al denunciante la suma de P3,742.50.
Dada la gravedad de los cargos, en vez de decretar una suspension indefinida, ordenamos que el recurrido sea inhabilitado en el ejercicio de la abogacia y que reintegre al recurrente la suma de P3,742.50 dentro del termino de un año, reservando a dicho recurrente la accion civil correspondiente, si transcurrido el plazo indicado no le fuese pagada la expresada cantidad. Asi se ordena.
