NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated June 20, 2018which reads as follows:
"G.R. No. 237629 (Roberto Figuro, Marissa Marquez, Darel C. Laxamana, Ferdinand Cervas, Rosalinda Ramos, Zenaida Mendiola, Joseph Christian Cifra, Teodula Pandy, Lanie Barnes, Manolita Rodriguez, Rodolfo Quintos, and Analiza C. Ramos v. Spouses Socrates and Rosalia Galfo). — The petitioners' motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review of the records, the Court resolves to DENY this petition for review on certiorari for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in dismissing the appeal for being the wrong remedy.
As correctly held by the CA, the proper recourse of an aggrieved party from the cases decided by the Regional Trial Court in the exercise of its original jurisdiction, as in this case, is to file a notice of appeal with the court which rendered the judgment or final order appealed from. 1
WHEREFORE, the petition is DENIED. The assailed Resolutions dated October 27, 2017 and February 19, 2018 in CA-G.R. SP No. 152675 are AFFIRMED. aTHCSE
Honorable Allan B. Ariola, in his official capacity as Presiding Judge of the Metropolitan Trial Court, Branch 48, Pasay City is DELETED as party respondent pursuant to Sec. 4, Rule 45, 1997 Rules of Civil Procedure, as amended.
