Please take notice that the Court, First Division, issued a Resolution datedJune 18, 2018which reads as follows:
"G.R. No. 237647 (Dennis F. Fajardo, et al. v. Kyocera Phils., Inc./Mr. Mitsuaki Kamata [President]/Elisa Gonzales [HRD]). — The motion for extension of time to file petition for review on certiorari under Rule 45 filed by petitioners is GRANTED.
After review of the records, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in upholding the Decision of the National Labor Relations Commission (NLRC), which in turn upheld the Decision of the Labor Arbiter (LA) to dismiss petitioners' complaint. Petitioners raise issues of facts. However, factual findings of the LA, when affirmed by the NLRC and the CA, are binding on this Court.
WHEREFORE, premises considered, the September 5, 2017 Decision and January 30, 2018 Resolution of the Court of Appeals in CA-G.R. SP No. 142429 are AFFIRMED.
