NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution datedJuly 15, 2019, which reads as follows:
"G.R. No. 244065 (Edilito Escalona y Sablay @ "Itok" vs. People of the Philippines). — This treats of the Petition for Review on Certiorari1 under Rule 45 of the Revised Rules of Court filed by petitioner Edilito Escalona y Sablay @ "Itok," seeking the reversal of the Decision 2 dated May 29, 2018, rendered by the Court of Appeals (CA) in CA-G.R. CR No. 40089, which affirmed the trial court's ruling convicting him of Lascivious Conduct punishable under Section 5 (b), Article III of Republic Act No. 7610. 3
After a perusal of the records of this case, the Court resolves to DENY the petition for failure to sufficiently show any reversible error in the assailed CA decision as to warrant the exercise of the Court's discretionary appellate jurisdiction.
WHEREFORE, the Court AFFIRMS with modification the Decision dated May 29, 2018, rendered by the Court of Appeals in CA-G.R. CR No. 40089, convicting petitioner Edilito Escalona y Sablay @ "Itok" of Lascivious Conduct under Section 5 (b), Article III of Republic Act No. 7610, thereby imposing upon him an indeterminate sentence of twelve (12) years, five (5) months, and ten (10) days of reclusion temporal minimum, as minimum, to seventeen (17) years, four (4) months, and one (1) day of reclusion temporal maximum, as maximum. In addition, petitioner Edilito Escalona y Sablay @ "Itok" shall pay AAA 4 the following amounts: (i) P50,000.00 as civil indemnity; (ii) P50,000.00 as moral damages; (iii) P50,000.00 as exemplary damages; and (iv) a fine of P15,000.00. All the amounts due shall be subject to a legal interest of six percent (6%) per annum from the date of the finality of this Resolution until full satisfaction.
