Please take notice that the Court, First Division, issued a Resolution dated March 25, 2019 which reads as follows:
"G.R. No. 243773 (Lodovico M. Eleazar, Jr., Edgar M. Eleazar, Rogelio E. Lopez, Jomar Camat and Billy Joe Collado vs. Eloisa Eleazar and Virgelio Eleazar)
After a perusal of the records of the case, the Court agrees with the findings of the Court of Appeals that there is probable cause to indict the petitioners. However, the determination of the proper offense to be charged against the petitioners should be handed to the prosecutor.
WHEREFORE, the complaint is hereby REMANDED to the Office of the Provincial Prosecutor of Lingayen, Pangasinan for the conduct of preliminary investigation on the incidents subject matter hereof in accordance with the mandates of Rule 112 of the Rules of Court and for the filing of the necessary information against the petitioners for the deaths of Rodrigo Eleazar and Gener Eleazar.
