Please take notice that the Court, First Division, issued a Resolution datedJuly 11, 2018which reads as follows: HTcADC
"G.R. No. 238648 (Marlon R. Dulnuan v. Government Service Insurance System [GSIS], GSIS Board of Trustees, and GSIS Committee on Claims). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
There being no reversible error in the Decision dated September 28, 2017 and Resolution dated March 16, 2018 of the Court of Appeals in CA-G.R. SP No. 138957, the petition is DENIED.
The CA correctly denied Marlon R. Dulnuan's (Dulnuan) petition for review since the premiums paid to GSIS, consisting of both government and the employee/pensioner's share, are apportioned between retirement and life insurance. Thus, the computation of Dulnuan of payment of 25% of his life insurance premiums is not based on the amount of P70,400.00, his total remittance to the GSIS. The CA and the GSIS correctly ruled that the termination value is 25% of P32,456.44 or the amount of P8,344.56 less deductions in the amount of P2,874.94 which ultimately resulted in the amount of P5,469.72.
WHEREFORE, the petition is DENIED. The Decision of the Court of Appeals in CA-G.R. SP No. 138957 and the GSIS Board of Trustees in Board Case No. 010-13 are AFFIRMED. aScITE
The Court of Appeals is DELETED as party respondent in this case pursuant to Sec. 4, Rule 45, 1997 Rules of Civil Procedure, as amended.
