Please take notice that the Court, First Division, issued a Resolution datedAugust 6, 2018which reads as follows:
"G.R. No. 240027 (Herminio Delfin joined by his wife Dolores Delfin v. Arturo Dullano joined by his wife Guillerma D. Dullano, et al.). — There being no reversible error in the Decision of the Court of Appeals dated April 28, 2017 in CA-G.R. CV No. 05259, the petition is DENIED.
The Court of Appeals correctly affirmed the Regional Trial Court's ruling that respondents have established by a preponderance of evidence possession de jure of the property with the presentation of Tax Declaration No. 24-226 covering Lot No. 1323-C and the Deeds of Confirmation of Sale respectively dated in 2001 and 2002. These documents, coupled with the testimony of the administrator, demonstrate that respondents have been in possession of the property since 1981 until December 2000 when Bernardo Ellan forcibly took possession of it. cSaATC
WHEREFORE, the petition is DENIED. The Decision of the Court of Appeals in CA-G.R. CV No. 05259 is AFFIRMED.
