Please take notice that the Court, First Division, issued a Resolution datedAugust 13, 2018which reads as follows: HTcADC
"G.R. No. 239774 (Juanita Dela Cruz, et al. v. Estelita Matamis-Dagdag). — The motion for extension of time to file petition for review on certiorari is DENIED for failure to indicate material dates showing the timeliness of its filing. Consequently, the petition for review on certiorari should be denied outright for being filed out of time.
In any event, after review, the Court finds that the petition failed to sufficiently show that the Court of Appeals (CA) committed any reversible error in its ruling. Both the trial court and the CA found respondent to have better right of possession than petitioners on account of the latter's failure to substantiate their claim of ownership to the land and allegation of fraud in the acquisition of Angel Matamis' title to the same. Petitioners raise factual questions which the CA have already addressed in its Decision dated July 19, 2017. In the absence of compelling reasons, the Court will not deviate from the rule that factual findings of the lower tribunals are final and binding on this Court. 1
WHEREFORE, the petition is DENIED. The Decision dated July 19, 2017 and Resolution dated April 25, 2018 of the Court of Appeals in CA-G.R. CV No. 102047 are AFFIRMED.
The Cash Collection and Disbursement Division is DIRECTED to RETURN to the petitioners the excess payment for the legal fees in the amount of P470.00 under O.R. No. 0211414-SC-EP dated June 21, 2018.
