Please take notice that the Court, First Division, issued a Resolution datedJuly 3, 2019 which reads as follows:
"G.R. No. 246060 (Melchor Dela Cruz v. Grieg Philippines, Inc./Grieg Star AS and/or Capt. Dennis P. Desabille). — After review, the Court resolves to DENY the petition for failure of petitioner to show any reversible error in the assailed ruling. The Court of Appeals (CA) correctly affirmed the ruling of the National Labor Relations Commission (NLRC) and the Labor Arbiter that the petitioner failed to prove that his illnesses are work-related. Factual findings of the NLRC, when sufficiently supported by evidence on record, and especially when affirmed by the CA, as in this case, are accorded respect, if not finality, and are considered binding on this Court.
WHEREFORE, premises considered, the petition is DENIED. The Decision dated July 24, 2018 and Resolution dated January 10, 2019 of the Court of Appeals in CA-G.R. SP No. 149729 are hereby AFFIRMED. HTcADC
The National Labor Relations Commission and the Court of Appeals are hereby DELETED as party respondents in this case, pursuant to Sec. 4, Rule 45, 1997 Rules of Civil Procedure, as amended; the notice of withdrawal of appearance of Atty. Jan Ale S. Fajardo of Fajardo and Associated Law Office as counsel for petitioner, with conformity, stating that petitioner has hired Atty. Jaime R. Tejero III as his new counsel, is NOTED; and Atty. Jan Ale S. Fajardo is required to SUBMIT within five (5) days from notice hereof, a soft copy in compact disc, USB or e-mail containing the PDF file of the signed notice of withdrawal of appearance pursuant to A.M. Nos. 10-3-7-SC and 11-9-4-SC.
