Please take notice that the Court, Second Division, issued a Resolution dated22 November 2017which reads as follows: HEITAD
"G.R. No. 230605 — Raul B. De Mesa, Rafael E. Evangelista, Antonio Cojuangco, Francisco E. Rodrigo, Jr., Rizaldy Tolentino, Emmanuel Don versus Dionisio P. Reyno and the Monetary Board of the Bangko Sentral ng Pilipinas
After reviewing the Petition and its annexes, inclusive of the Court of Appeals' (CA) Decision 1 dated October 11, 2016 and Resolution 2 dated March 9, 2017 in CA-G.R. SP No. 140788, the Court resolves to DENY the Petition and AFFIRM the Decision and Resolution of the CA since the petitioners failed to sufficiently show that the CA committed any reversible error in the assailed Decision and Resolution as to warrant the exercise of this Court's discretionary appellate jurisdiction.
Banks are required to exercise the highest degree of diligence in the conduct of their affairs. 3 Moreover, findings of administrative agencies are entitled to great respect and even finality when supported by substantial evidence and have been affirmed by the CA. In this case, the CA held that it is undisputed that the loan to DHN Construction and Development Corporation was processed and approved by the Bank of Commerce in the absence of a loan application from the former. The CA also noted that the records show that the petitioners had been remiss in their duty, and that they failed to exert efforts to protect the bank's interest.
