NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated June 30, 2021 which reads as follows:
"G.R. No. 255017 (Susan De Leon y Tabalon v. People of the Philippines). — After a perusal of the records of the case, this Court resolves to deny the Petition for Review on Certiorari1 for failure of petitioner Susan De Leon y Tabalon (De Leon) to sufficiently show that the Court of Appeals committed reversible error in upholding her conviction for the crimes of illegal recruitment under Republic Act No. 8042 and estafa under paragraph 2 (a), Article 315 of the Revised Penal Code, as amended.
However, it should be clarified that the legal interest applied to the amount of P169,000.00 that De Leon must return to private complainant Marife S. Cabalan is per annum.
WHEREFORE, the petition is DENIED. The Decision dated March 13, 2020 and the Resolution dated December 14, 2020 of the Court of Appeals in CA-G.R. CR No. 43381 finding petitioner Susan De Leon y Tabalon GUILTY beyond reasonable doubt of the crimes of illegal recruitment under Republic Act No. 8042 and estafa under paragraph 2 (a), Article 315 of the Revised Penal Code, as amended, and sentencing her to the following penalties: (1) in Criminal Case No. 149467, imprisonment of six (6) years and one (1) day as minimum to twelve (12) years as maximum, and to pay a fine of P500,000.00; and (2) in Criminal Case No. 149468, imprisonment of four (4) months of arresto mayor as minimum to one (1) year and eight (8) months of prision correccional as maximum, are AFFIRMED with MODIFICATION in that petitioner Susan De Leon y Tabalon is ORDERED to return to private complainant Marife S. Cahalan the amount of P169,000.00, subject to interest at the rate of six percent (6%) per annum from the date of finality of this Resolution until fully paid.
SO ORDERED."
