SECOND DIVISION
[G.R. No. 248508. September 2, 2019.]
DBP SERVICES CORP., DBPSC SECURITY SERVICE, INC., AND BOARD OF DIRECTORS AND OFFICERS, petitioners, vs.BONIFACIO B. MANZANO II, CELSO L. TALO, AND JOECEL V. PASLON, respondents.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated02 September 2019which reads as follows:
"G.R. No. 248508 — (DBP Services Corp., DBPSC Security Service, Inc., and Board of Directors and Officers v. Bonifacio B. Manzano II, Celso L. Talo, and Joecel V. Paslon.) — The application for temporary restraining order and/or writ of preliminary injunction is DENIED.
After review, we resolve to DENY the petition for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in its Decision dated 22 February 2019 and Resolution dated 1 July 2019.
We note that the Labor Arbiter, National Labor Relations Commission (NLRC), and CA unanimously found that respondents were illegally dismissed. Factual findings of quasi-judicial bodies like the NLRC, if supported by substantial evidence, are accorded respect and even finality by this Court, more so when they coincide with those of the Labor Arbiter. Such factual findings are given more weight when the same are affirmed by the CA. 4 We find no reason to depart from this rule.
WHEREFORE, the Decision of the Court of Appeals dated 22 February 2019 and Resolution dated 1 July 2019 in CA-G.R. SP No. 08857-MIN are AFFIRMEDwith MODIFICATION. Consistent with prevailing jurisprudence, the monetary award shall earn 6% legal interest per annum from finality of this resolution until fully paid. 5
SO ORDERED."
Very truly yours,
MARIA LOURDES C. PERFECTODivision Clerk of CourtBy:
