DANGEROUS DRUGS BOARD, petitioner,vs. MONICA JANE FRANCES E. MEDINA AND BERNARDO T. MEDINA, JR., respondents.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedApril 23, 2018which reads as follows:
"G.R. No. 236567 (Dangerous Drugs Board v. Monica Jane Frances E. Medina and Bernardo T. Medina, Jr.). — The motion for extension of time to file petition for review under Rule 45 of the Rules of Court filed by petitioner is GRANTED. ATICcS
Nevertheless, after review of the records, the Court resolves to DENY the petition for failure of petitioner to show any reversible error in the assailed ruling. Both the Regional Trial Court and the Court of Appeals (CA) found that the facts surrounding the case do not warrant the compulsory confinement of respondents Monica Jane Frances E. Medina and Bernardino T. Medina, Jr. Absent any clear showing of abuse, arbitrariness, or capriciousness committed by the lower court, its findings of facts, especially when affirmed by the CA, as in this case, are accorded respect, if not finality, and are considered binding on this Court.
WHEREFORE, premises considered, the petition is DENIED. The June 21, 2017 Decision and January 12, 2018 Resolution of the Court of Appeals in CA-G.R. SP No. 146153 are hereby AFFIRMED.
The counsel for petitioner is hereby required to COMPLY within five (5) days from notice hereof, with Bar Matter No. 1922 which makes mandatory for all lawyers to indicate in all pleadings filed with the Court their respective MCLE Certificates of Compliance Number or Certificates of Exemption, as the MCLE Compliance of petitioner's counsel lacks the date of issuance.
SO ORDERED." Sereno, C.J., on leave; Leonardo-de Castro, J., designated as Acting Chairperson of the First Division per Special Order No. 2540 dated February 28, 2018. ETHIDa
Very truly yours,
